Tribute: Justice Kennedy’s counter-clerks

Leah Litman is an assistant professor of law at UC Irvine School of Law. She clerked for Justice Anthony Kennedy during the October 2011 term. Other justices are celebrated for hiring counter-clerks — clerks who are hired because they often disagree with a justice, not in spite of it.
