Good Behaviour #5: “Constitutional Hardball”

Justice Anthony Kennedy has announced his retirement. What now? We continue our series on Supreme Court vacancies, with Dan Epps and Leah Litman — both former Kennedy clerks — setting the stage.

“Good Behaviour” is First Mondays’ series of episodes covering Supreme Court vacancies and nominations. The title comes from Article III of the Constitution, which provides that federal judges “shall hold their offices during good behaviour.” The series began last year to cover the nomination and confirmation process for then-Judge Neil Gorsuch. Earlier episodes in the series are available below the jump. (Please note that Good Behaviour #3, covering the failed nomination of Chief Judge Merrick Garland, was only available for Patreon subscribers).
