Oklahoma v. Department of Health and Human Services
Petition for writ of certiorari granted, judgment vacated, and case remanded to the U.S. Court of Appeals for the 10th Circuit for further consideration in light of Medina v. Planned Parenthood South Atlantic on June 30, 2025.
Issue: (1) Whether a federal agency, through regulations, can impose upon states a funding condition that satisfies the Constitution's spending clause when the underlying statute does not contain or is ambiguous as to that condition; and (2) whether the Weldon Amendment prohibits the federal government from requiring a state's health department to provide abortion referrals.
