Issue: Whether the U.S. Court of Appeals for the 9th Circuit erred in holding, in conflict with the U.S. Court of Appeals for the 5th Circuit, that the Environmental Protection Agency’s interpretation of the Clean Air Act’s contingency measures provision, 42 U.S.C. § 7502(c)(9), was arbitrary, capricious, an abuse of discretion or otherwise not in accordance with the law.
