Title: School District of the City of Pontiac v. Duncan
Issue: WhetherÂ Congress provided the required clear and unambiguousÂ noticeÂ that the acceptance by states and school districtsÂ of funds under the No Child Left BehindÂ Act is conditioned uponÂ an obligation that they spend their own funds andÂ incur costs to comply with requirements of the ActÂ even if the federal funding provided under the ActÂ falls far short of paying for the costs of satisfyingÂ those requirements.

Issue: WhetherÂ the Tenth Circuit violated 28 U.S.C. Â§ 2254(d)(1) by granting habeas relief for ineffective assistance of counsel during plea bargain negotiations to a defendant who wasÂ later convicted and sentenced in a fair trial,Â on the ground that the remedyÂ the Oklahoma Court of Criminal Appeals gave to the defendant wasÂ constitutionally inadequate, given that the Supreme CourtÂ has not clearly established what remedy, if any, isÂ appropriate for ineffective assistance of counsel in such a case.
