Walmsley v. Federal Trade Commission
Petition for writ of certiorari granted, judgment vacated, and case remanded to the U.S. Court of Appeals for the 8th Circuit for further consideration in light of FCC v. Consumers' Research on June 30, 2025.
Issue: (1) Whether the Horseracing Integrity and Safety Act unlawfully delegates enforcement power to the Horseracing Integrity and Safety Authority; and (2) whether the act unlawfully delegates rulemaking power to the authority.
