Issue: Whether the U.S. Court of Appeals for the 9th Circuit erred in holding that a noncitizen placed in withholding of removal proceedings before an immigration judge is subject to detention under 8 U.S.C. § 1231(a)"the detention authority created by Congress for a person with a final order of removal that has not yet been executed"as opposed to 8 U.S.C. § 1226"the detention authority Congress created for a person awaiting a determination of whether they may remain in the United States.
