Issue: Whether the U.S. Court of Appeals for the 10th Circuit erred in reversing a judgment denying qualified immunity to a 911 operator and holding, in accord with the U.S. Courts of Appeals for the 4th and 5th Circuits, but in contrast to the U.S. Courts of Appeals for the 2nd, 6th, 7th, 8th, and 9th Circuits, that a 14th Amendment state-created danger claim covers only conduct by a state actor that imposes limitations on a person's freedom to act on his own behalf.
