Petition for writ of certiorari granted, judgment vacated, and case remanded to the U.S. Court of Appeals for the 9th Circuit for further consideration in light of United States v. Skrmetti on June 30, 2025.
Issue: (1) Whether a policy declining coverage for sex-reassignment surgeries violates the equal protection clause of the 14th Amendment; and (2) whether clearly established law as of July 2022 held that a policy declining coverage for sex-reassignment surgeries violates the equal protection clause.
