Issue: Whether, given that the state law’s designated trier of fact concluded that the four petitioners were each ineligible for the death penalty under the state law, the state supreme court erred under the Double Jeopardy Clause as explained in Bullington v. Missouri, by remanding for further proceedings that could expose petitioners to the death penalty.
