Wednesday round-up

Briefly:

  • At Balkinization, Marty Lederman explains why, in Masterpiece Cakeshop v. Colorado Civil Rights Commission, in which the court will decide whether the First Amendment bars Colorado from requiring a baker to create a cake for a same-sex wedding, “the ‘religious hostility’ theory of the case for Masterpiece is weaker than some Justices might have assumed.”
  • Subscript offers a graphic explainer of Supreme Court case law governing when the establishment clause of the First Amendment bans religious holiday displays on government property.
