As Lyle reported for the blog, yesterday Justice Breyer denied the application for a stay filed by Illinois Senator Roland W. Burris, who had asked the Court to block a special Senate election in his state.  MSNBC, Forbes, The Hill, and the New York Times all have coverage.

Briefly:

  • ACSblog links to an issue brief that analyzes Bell Atlantic Corp. v. Twombly and Ashcroft v. Iqbal, cases that implemented a more stringent pleading standard for legal claims; the authors of the issue brief contend that recent decisions such as these restrict access to courts.
  • Ballot Access News reports that Herb Lux, an independent candidate for Congress in Virginia, has asked the U.S. Supreme Court to order the Virginia State Board of Elections to check his petition for validity. (Thanks to ElectionLawBlog for the link).
