Today at the Supreme Court | 11.6.07

At 10 a.m., the Court is scheduled to hear argument in John R. Sand & Gravel v. United States (06-1164), asking whether the Tucker Act’s six-year statute of limitations is jurisdictional (and may thus not be waived by the parties). Jeffrey K. Haynes of Bloomfield Hills, Mich., will argue for the petitioner, and Malcolm L. Stewart of the Solicitor General’s office will argue for the respondent.

At 11 a.m, the Court is scheduled to hear argument in Federal Express v. Holowecki (06-1322), asking whether submitting an in-take questionnaire to the EEOC constitutes the requisite filing of a “charge” before a party brings a private lawsuit. Connie L. Lensing of Memphis, Tenn., will argue for the petitioner, and David L. Rose of Washington, D.C., and Toby J. Heytens of the Solicitor General’s office will argue for the respondent.
