KSR v. Teleflex: Respondent’s Brief
on Oct 17, 2006 at 6:50 pm
Yesterday, we filed this Brief for the Respondents in the matter of KSR v. Teleflex; the case involves the proper test for deeming a patent invalid as “obvious.” Oral argument is set for November 28.
The top-side briefs in this case were due on August 22nd and were collected in this earlier post. Tomorrow we intend to post the many amicus briefs that were also filed yesterday; several that were filed in advance of the deadline are already available available at this post on the PatentlyO blog.
Tom Goldstein is counsel of record on yesterday’s filing and will be arguing on behalf of Teleflex before the Court. Several other Akin Gump attorneys assisted in the brief’s preparation, including Michael O’Shea, Garreth Sarosi, Chris Pudelski, Sarah Rispin, Tracy Casadio and Elizabeth Rader; also on the brief are Ken Bass and Rob Sterne of the firm Sterne, Kessler; Roger Young, Steve Susser, and David Poirier of Young & Susser; and Sam Haidle and David LaPrairie of Howard & Howard.
