Hughes v. United States

Docket No.17-155
Op. Below11th Cir.
ArgumentMar 27, 2018

Holding

A Federal Rule of Criminal Procedure 11(c)(1)(C) plea agreement is "based on" the defendant's Federal Sentencing Guidelines range so long as that range was part of the framework the district court relied on in imposing the sentence or accepting the agreement; thus, Erik Hughes may seek a sentencing reduction under 18 U.S.C. 3582(c)(2).

Judgment

Reversed and remanded, 6-3, in an opinion by Anthony McLeod Kennedy on Jun 4, 2018. Justice Sotomayor filed a concurring opinion. Chief Justice Roberts filed a dissenting opinion, in which Justices Thomas and Alito joined.
