Chevron USA Inc. v. Plaquemines Parish, Louisiana

Docket No.24-813
Op. Below5th Cir.
ArgumentJan 12, 2026

Holding

Chevron has plausibly alleged a close relationship between its challenged crude-oil production and the performance of its federal aviation gas refining duties and has therefore satisfied the “relating to” requirement of the federal officer removal statute.

Judgment

Vacated and remanded, 8-0, in an opinion by Clarence Thomas on Apr 17, 2026. Justice Jackson wrote an opinion concurring in the judgment. Justice Alito took no part in the consideration of the case.
