Issue: (1) Whether the Federal Mine Safety and Health Act"s definition of "the work of preparing coal" includes purchasers of processed and prepared coal; and (2) whether the Court of Appeals should have remanded to the Federal Mine Safety and Health Review Commission to consider the evidence that the statute had been inconsistently applied.
