Issue: (1) Whether Georgia's implied consent statute – under which a driver arrested for driving under the influence who refuses to consent to a blood draw has his driver’s license suspended for at least a year, with the refusal usable as evidence of guilt at a criminal trial – violates the unconstitutional conditions doctrine; and (2) whether Georgia's implied consent statute, due to substantial adverse consequences of refusal to consent, is impermissibly coercive so as to render consent involuntary.
