Issue: Whether, as the First Circuit alone has held, a lawsuit asserting claims arising out of federal employees’ conduct that is tortious is nevertheless implicitly exempt from the Federal Tort Claims Act (“FTCA”), which provides that the United States may be sued and shall be liable for the torts of federal employees acting within the scope of their employment, because the conduct also violates a federal statute, regulation, or policy that does not itself authorize suits for damages.
