The unique trust relationship between the U.S. and Indian Tribes.

On Monday the Court issued its opinion in United States v. Jicarilla Apache Nation (No. 10-382), holding that the federal government may structure its trust relationship with the Tribe without assuming all of the duties of a private trustee. Thus, the Tribe could not invoke the fiduciary exception to the attorney-client privilege to compel the disclosure of documents held by the government.
