Today at the Court
We are expecting orders — but not opinions — at 10 a.m. this morning. The Court will then hear oral argument in the following two cases:
10 a.m. – In Macs Shell Service, Inc. v. Shell Oil Products Company; Shell Oil Products Company v. Macs Shell Service (Nos. 08-240 & 08-372), the Court will consider the circumstances under which a service-station operator may bring suit against an oil refiner or distributor for constructive termination under the Petroleum Marketing Practices Act. 11 a.m. – At issue in Granite Rock Company v. International Brotherhood of Teamsters (08-1214) is a federal courts jurisdiction to determine collective bargaining agreement formation and whether a union that is not a direct signatory to the collective bargaining agreement may be sued under Section 301(a) of the Labor Management Relations Act. Yesterday, Timothy Tatarka of Stanford Law School discussed the issues in the case for SCOTUSblog.
