Issues:(1) Whether private security guards contracted by the State Department to provide diplomatic security in Iraq, performing that State Department responsibility at the time of the charged offense conduct, are employed by the Armed Forces outside the United States under the Military Extraterritorial Jurisdiction Act, 18 U.S.C. 3261(a)(1), 3267(1)(A); and (2) whether a trial court violates criminal defendants right to jury trial by removing the disputed issue of venue from the jury.
