Wednesday round-up

Yesterday, relying on the U.S. Supreme Court’s decision in January invalidating Florida’s death penalty scheme, the Delaware Supreme Court struck down that state’s death penalty law.  Coverage comes from Lyle Denniston at his eponymous blog, Pete Williams and the Associated Press at NBC News, and Erik Eckholm of The New York Times, while Kent Scheidegger has commentary on the ruling for Crime and Consequences.

Briefly:

• At his Election Law Blog, Rick Hasen reports that a candidate for a Montana state court judgeship has asked the Supreme Court to intervene in a case involving state rules that restrict “false statements by and about judicial candidates.”
• In an op-ed for The Atlantic, David Gans suggests that the late Justice Antonin Scalia may have had “perhaps his greatest impact” “writing or joining opinions that radically changed the law in a way that made it harder for individuals to have their day in court to vindicate their federal rights.”
