Court-related coverage and commentary continue to focus on the oral arguments eleven days from now in the challenges to state bans on same-sex marriage. - At Slate, Rick Hasen criticizes Hillary Clinton’s suggestion of a constitutional amendment to overturn the Citizens United decision, arguing that “it is much easier to change the Constitution by changing the Supreme Court than by passing an amendment.”
- An op-ed in The Wall Street Journal (subscription required) urges the Court to grant review in Spokeo v. Robins, a case scheduled for today’s Conference that asks that Justices to consider “whether companies can be held liable in civil court for violating a federal statute, even if no one was harmed.”
