Thursday round-up

With the Court scheduled to issue decisions today at 10 a.m., some coverage of the Court focuses on the decisions – especially the high-profile ones — that could be released today.  In USA Today, Richard Wolf summarizes his six “cases to watch” between now and the end of June, while Stephanie Condon has a similar feature for CBS News.  In The Washington Post, Cecelia Kang looks ahead to the Court’s upcoming decision in American Broadcasting Cos. v. Aereo, in which the Justices are considering whether a company “publicly performs” a copyrighted television program when it retransmits a broadcast of that program to thousands of paid subscribers over the Internet, and in particular the possible effect of that decision on the National Football League.

Briefly:

• At Cato at Liberty, Ilya Shapiro discusses the amicus brief that Cato filed in next Term’s Heien v. North Carolina, in which the Court will consider whether a police officer’s mistake provides the reasonable suspicion necessary under the Fourth Amendment to pull someone’s car over, and he urges the Court to “make clear that law enforcement mistakes of law preclude lawful searches and seizures under the Fourth Amendment.”
• At ACSblog, Laurence Tribe discusses Uncertain Justice, his new book with Joshua Matz.
• In an op-ed for The Washington Post, Charles Lane discusses the Court’s decision on Monday not to review the Argentine bond cases and suggests that perhaps the “status quo needed this shake-up.”
• At Re’s Judicata, Richard Re discusses the Roberts Court’s “interesting uses of precedent, including a proliferation of doctrines that purport to dilute the power of stare decisis.”
