- Discussing the challenges to the Affordable Care Act’s contraception mandate, the editorial board of The New York Times urges the Court to consider what it characterizes as “the strongest single argument” against the challengers: “the Constitution’s establishment clause enforcing the separation of church and state and barring government from favoring one religion over another or nonbelievers.”
