The Court has released the opinion in Negusie v. Holder (07-499). The decision below, which held for the government, is reversed and remanded, in an 8-1 opinion authored by Justice Kennedy. Justice Scalia filed a concurring opinion, joined by Justice Alito, and Justice Stevens filed an opinion concurring in part and dissenting in part, joined by Justice Breyer.  Justice Thomas filed a dissenting opinion. The Court has released the opinion in Summers, et al. v. Earth Island Institute, et al. (07-463). The decision below, which held in part for the conservation groups, is reversed in part and affirmed in part in a 5-4 opinion written by Justice Scalia. Justice Kennedy filed a concurring opinion. Justice Breyer filed a dissenting opinion, joined by Justices Stevens, Souter, and Ginsburg. The opinion is available here.
