At 10 a.m., the Court is scheduled to hear argument in Greenlaw v. United States (07-330), involving appellate judges’ ability to increase sentences sua sponte. Amy Howe of Washington, D.C. (and this blog) will argue for the petitioner, Deanne E. Maynard of the Solicitor General’s office will argue for the United States, and Jay T. Jorgensen of Washington, D.C., will argue as amicus curiae in support of the judgment below.

At 11 a.m., the Court is scheduled to hear argument in Irizarry v. United States (06-7517), involving judges’ duty to notify parties before departing from the sentencing guidelines. Arthur J. Madden, III, of Mobile, Ala., will argue for the petitioner, Matthew D. Roberts of the Solicitor General’s office will argue for the United States, and Peter B. Rutledge of Washington, D.C., will argue as amicus curiae in support of the judgment below.
