At 10 a.m., the Court is expected to release one or more opinions on the merits. We will provide those opinions as soon as possible.
The Court is then scheduled to hear argument in Riegel v. Medtronic (06-179), asking whether federal law preempts state lawsuits against medical devices approved by the FDA. Allison M. Zieve of Washington, D.C., will argue for the petitioner, and Ted Olson of Washington, D.C., and Edwin S. Kneedler of the Solicitor General’s office will argue for the respondent.
At 11 a.m., the Court is scheduled to hear argument in Snyder v. Louisiana (06-10119), asking whether a Louisiana prosecutor improperly struck black jurors from the defendant’s murder trial in light of a subsequent comparison of the case during the penalty phase to the O.J. Simpson trial. Stephen B. Bright of Atlanta will argue for the petitioner, and Terry M. Boudreaux of the Louisiana Attorney General’s office will argue for the respondent.
