Without oral argument, the Court returned this case to a lower court to consider whether to hold a hearing to investigate whether the trial judge and jury in the defendant’s trial engaged in significant misconduct that could undermine the validity of his death sentence.

Judgment

Vacated and remanded, 5-4 on Jan 19, 2010. Justice Scalia dissented, joined by Justice Thomas. Justice Alito dissented separately, joined by Chief Justice Roberts.
