The U.S. Court of Appeals for the 4th Circuit's judgment that the Atomic Energy Act does not preempt Virginia's prohibition on uranium mining in the commonwealth is affirmed.

Judgment

Affirmed, 6-3, in an opinion by Neil Gorsuch on Jun 17, 2019. Justice Gorsuch announced the judgment of the court and delivered an opinion, in which Justices Thomas and Kavanaugh joined. Justice Ginsburg filed an opinion concurring in the judgment, in which Justices Sotomayor and Kagan joined. Chief Justice Roberts filed a dissenting opinion, in which Justices Breyer and Alito joined.
