Sabine River Authority v. Bonin

Issue
(1) Whether the U.S. Court of Appeals for the 5th Circuit erred in finding that the Texas district court has subject-matter jurisdiction over petitioner, an entity both Louisiana state courts and the 5th Circuit itself have recognized is a state agency of Louisiana; (2) whether, the 5th Circuit erred when it applied inapplicable precedent to override Louisiana legislation that specifically and unambiguously defines petitioner as an "agency and instrumentality of the state of Louisiana"; and (3) whether the 5th Circuit erred when it did not consider Louisiana"s civil-law tradition, thereby placing the state at an inherent disadvantage to all other states in the union with respect to sovereign immunity under the 11th Amendment.
