Rodriguez v. Sebelius

(1) Whether the contingent or non-contingent nature of attorneys" fees is a proper consideration in fixing the lodestar amount under federal fee-shifting statutes; and (2) whether Vaccine Act litigation is sufficiently complex so as to warrant awards of attorneys" fees at prevailing market rates commonly awarded in other federal fee-shifting litigation.
