PLIVA Inc. v. Superior Court of California, San Francisco County
Petition for certiorari denied on October 2, 2017.
Issue
Whether, when a state court lacks personal jurisdiction in lawsuits against a defendant, and the state court combines those lawsuits into a coordination proceeding with other lawsuits where personal jurisdiction exists, a defendant's participation in the state-court coordination proceeding constitutes a waiver of the defendant's fundamental right not to be subject to the coercive power of a state court that lacks personal jurisdiction over it or consents to that court's exercise of personal jurisdiction over it in every individual lawsuit coordinated under the state-court procedures.
