Nelson v. Time Warner Cable Inc.

(1) Whether the statute governing Texas"s transition from municipal-level to state-level cable franchising is subject to strict scrutiny under the Speech and Press Clauses of the First Amendment; and (2) whether a federal court of appeals can hold unconstitutional a state statute that has been amended during the pendency of the appeal, without first allowing the state to make a record in defense of the amended statute.
