(1) Whether a plaintiff can preclude conduct-based immunity for foreign government officials merely by suing them in their personal capacities; and (2) whether the Torture Victim Protection Act abrogates all common-law conduct-based immunity for foreign officials, as the U.S. Court of Appeals for the District of Columbia Circuit held below, or leaves immunity intact, as the U.S. Courts of Appeals for the 2nd and 9th Circuits have held.
