(1) Whether a lower court's grant of habeas relief on the ground that a defendant unambiguously and unequivocally invoked his Miranda right to counsel during interrogation violates the federal habeas statute, 28 U.S.C. § 2254(d)(1); and (2) whether a defendant's request for an attorney was “unambiguous or unequivocal”? so as to preclude the use of his incriminating statements to police under Miranda v. Arizona (1969) and Davis v. United States (1994).
