(1) Whether permanently attaching a GPS tracking device to a sex offender"s body and continuously tracking her in public and private places solely on the basis of her prior conviction for a sex offense and not on her current dangerousness constitutes punishment such that imposing it post-sentencing violates the Ex Post Facto Clause; and (2) whether permanently attacking a GPS tracking device to a sex offender"s body and continuously tracking her in public and private places for ten years without review solely on the basis of her prior conviction for a sex offense and not on her current dangerousness violates the Fourteenth Amendment"s Due Process Clause.
