Chiles v. Salazar (Conversion Therapy)
Holding
Colorado’s law banning conversion therapy, as applied to petitioner’s talk therapy, regulates speech based on viewpoint, and the lower courts erred by failing to apply sufficiently rigorous First Amendment scrutiny.
Judgment
Reversed and remanded, 8-1, in an opinion by Neil Gorsuch on Mar 31, 2026. Justice Kagan wrote a concurring opinion, joined by Justice Sotomayor. Justice Jackson wrote a dissenting opinion.
