(1) Whether a criminal defendant can knowingly and voluntarily waive the right to appeal a district court’s yet-to-be-made errors as part of a plea agreement; (2) whether, if so, limits exist on the validity and enforceability of such appeal waivers; and (3) whether the appeal waiver in this case qualifies for the “miscarriage of justice” exception.
