Al-Maqablh v. Heinz
Petition granted, judgment vacated, and case remanded to the U.S. Court of Appeals for the 6th Circuit for further consideration in light of Thompson v. Clark.
Issue: Whether the U.S. Court of Appeals for the 6th Circuit"s decision, rejecting Ali Al-Maqablh's claim on the ground that the prosecution terminated in a manner that did not affirmatively indicate his innocence or demonstrate that a conviction had become improbable, should be vacated and remanded for reconsideration in light of Thompson v. Clark, in which the Supreme Court held that, to satisfy the favorable-termination requirement for a malicious-prosecution claim under 42 U.S.C. § 1983, a plaintiff "need only show that his prosecution ended without a conviction."
