(1) Whether the "discovery rule" applies to toll the one-year statute of limitations under the Fair Debt Collection Practices Act, 15 U.S.C. §" 1692, et seq., as the U.S. Courts of Appeals for the 4th and 9th Circuits have held, but the U.S. Court of Appeals for the 3rd Circuit has held contrarily; and (2) whether the discovery rule under the Fair Debt Collection Practices Act tolls the one-year statute of limitations to run from the date of discovery of the facts of the cause of action, as the U.S. Courts of Appeals for the 4th and 9th Circuits have held, or from the date of discovery of merely the injury, as the U.S. Court of Appeals for the 2nd Circuit has held contrarily.
