Issue
1. Given that this Court has said that a single digit maximum ratio between punitive damages and compensatory damages is appropriate in all but the most exceptional of cases, but greater ratios may comport with due process when "a particularly egregious act has resulted in only a small amount of economic damages," what factors determine whether conduct is "particularly egregious," whether economic damages are "small" as opposed to nominal, and what upper limits apply once a single digit ratio is exceeded? 2. When economic damages are above nominal, but arguably "small," does a punitive damages award that bears a triple-digit ratio to the compensatory damages violate Ppetitioner"s due process rights under the Fourteenth Amendment to the United States Constitution?
