Al-Maqablh v. Heinz
Petition granted, judgment vacated, and case remanded to the U.S. Court of Appeals for the 6th Circuit for further consideration in light of Thompson v. Clark.
Issue
Whether the U.S. Court of Appeals for the 6th Circuit"s decision, rejecting Ali Al-Maqablh's claim on the ground that the prosecution terminated in a manner that did not affirmatively indicate his innocence or demonstrate that a conviction had become improbable, should be vacated and remanded for reconsideration in light of Thompson v. Clark, in which the Supreme Court held that, to satisfy the favorable-termination requirement for a malicious-prosecution claim under 42 U.S.C. § 1983, a plaintiff "need only show that his prosecution ended without a conviction."
