Pomponio v. Black

Issues: (1) Whether a person who was criminally charged, but never confined or subjected to any non-standard pretrial restrictions, may rely on the “continuing seizure” doctrine to state a Fourth Amendment “malicious prosecution” claim against investigating officers; and (2) whether a criminal defendant has suffered a deprivation of liberty to which procedural due process attaches if that defendant remained at liberty pending trial, was not subject to any non-standard pretrial restrictions, and was acquitted at trial.
