Issue: (1) Whether a lower court's grant of habeas relief on the ground that a defendant unambiguously and unequivocally invoked his Miranda right to counsel during interrogation violates the federal habeas statute, 28 U.S.C. § 2254(d)(1); and (2) whether a defendant's request for an attorney was “unambiguous or unequivocal†so as to preclude the use of his incriminating statements to police under Miranda v. Arizona (1969) and Davis v. United States (1994).
