Sinegal v. Polk

Issue: (1) Whether candidacy for political office, standing alone, is a protected right under the First Amendment; and (2) whether the U.S. Court of Appeals for the 5th Circuit erred in holding that the petitioner was not entitled to qualified immunity when the precedent in that circuit did not clearly establish that candidacy alone was a protected First Amendment right until a year after the petitioner terminated the respondent"s employment.
