On October 15, the Court will hear oral arguments in Schuette v. Coalition to Defend Affirmative Action, in which it will consider whether Michigan violated the Equal Protection Clause when it amended its constitution to prohibit race- and sex-based discrimination or preferential treatment in public-university admissions decisions. This week the blog will host an online symposium to consider how the Court ought to approach this question and how the Justices might rule. Contributors will include:
Richard Epstein – New York University School of Law
Melissa Hart – Colorado Law at University of Colorado, Boulder
Gail Heriot – University of San Diego School of Law
John Neiman – Solicitor General of Alabama
Girardeau Spann – Georgetown University Law Center
Michael Smith – The Smith Appellate Law Firm
