The Court is scheduled to hold a conference on Friday; on Monday, the final sitting of the Term will begin.

Briefly:

  • At Reuters, Moira Herbst argues that predictions of a total victory for Wal-Mart in Wal-Mart v. Dukes, the gender-discrimination class action, may have been premature. She suggests that Justice Thomas might be a “wild card” and that at least a partial victory for the plaintiffs [is] not out of the question.”
  • At the Cockle Bur, Palma Joy Strand argues that [t]o say the recent Supreme Court case of Connick v.Thompson, which held that there is no Section 1983 liability for failure to train based on a single Brady violation, has racial undertones is akin to observing that the Pacific Ocean is wet.
