The Court is scheduled to hold a conference on Friday; on Monday, the final sitting of the Term will begin.
Briefly:
- At Reuters, Moira Herbst argues that predictions of a “total victory” for Wal-Mart in Wal-Mart v. Dukes, the gender-discrimination class action, “may have been premature.” She suggests that Justice Thomas might be a “wild card” and that “at least a partial victory for the plaintiffs [is] not out of the question.”
- At the Cockle Bur, Palma Joy Strand argues that “[t]o say the recent Supreme Court case of Connick v.Thompson,” which held that there is no Section 1983 liability for failure to train based on a single Brady violation, “has racial undertones is akin to observing that the Pacific Ocean is wet.”
