At 10 a.m., the Court will hear argument in Arizona v. Johnson (07-1122), on whether police may frisk car passengers they believe may be armed but have no reason to suspect have committed any crime. Assistant Arizona Attorney General Joseph Parkhurst and Toby Heytens of the Solicitor General’s office will argue for the petitioner, and Andrew Pincus of Washington, D.C., will argue for the respondent.
At 11 a.m., the Court will hear argument in Cone v. Bell (07-1114), on whether a death row prisoner is entitled to federal habeas review of his claim that the state suppressed evidence of drug use at the time of the murder for which he was convicted. Tom Goldstein of Washington, D.C., (and this blog) will argue for the petitioner, and Tennessee Associate Deputy Attorney General Jennifer Smith will argue for the respondent.
